Mediation once a dispute has arisen
The methods we apply vary depending on the needs of the companies undertaking mediation, their corporate culture and the nature of the dispute. We can include an assessment phase in the mediation process if our clients expressly request this.
We insist on the recognition phase as part of the process to ensure that the solution to the dispute will be durable.
In every case, our aim is to seize the opportunities to eliminate or minimise the negative impacts of a conflict and arrive at a negotiated solution that satisfies all the parties involved, in a way that strengthens their business structures and the working of their teams.
Preventive or project mediation
We support companies in ensuring the long-term success of their projects and partnerships, including in terms of their legal obligations in Corporate Social Responsibility. We favour an inclusive process that enables all the stakeholders to play a part in devising lasting and coherent solutions to make their projects successful.
In this context, one member of M4bb undertook a joint mediation as part of the setting up and management of an industrial complex in a region where the local community was hostile. The mediation made it possible to re-establish cooperation between all the stakeholders and the project went forward on a sound footing.
We can bring outside expertise to bear in building cohesive teams by facilitating dialogue and consistency in internal actions, especially in the context of corporate restructuring and change management, as well as in joint ventures.
In this context, one member of M4bb facilitated the setting up of a new power-sharing arrangement following a corporate merger.
Costs
The M4bb team will work with you to evaluate the feasibility of involving one or more of its members, and on what terms, among other things by identifying the risk areas. No charge is made for the first two hours of this preparatory phase.
Once the needs are identified, terms of reference for the mediation are signed, which include as detailed as possible an estimate of the number of days of mediation and the costs of the services. A deposit is payable before the mediation process begins.
